The Ford government is appealing a court decision that declared Bill 124 unconstitutional.
That was the law limiting public sector raises to one per cent annually.
In a notice of appeal filed Thursday, the province argues the judge erred in their decision, which found the bill in violation of two sections of the charter.
Justice Markus Koehnen came to that conclusion last month, saying the law violated workers’ right to collective bargaining and freedom of association.
But officials with the government have maintained that the charter only protects the process of bargaining, not the outcome.
Unions reacted to the news with anger, though the government had said from the start it would be appealing.
